Defining the goals and problems for deciding what training data to collect and how to label the data are also among the aspects that designers use when creating an algorithm (Završnik, 2019). Compiling databases and creating prediction algorithms always requires decisions made by humans. It is important to determine how this data is collected, cleaned and prepared. Governments around the world are developing AI and automated decision-making (ADM) systems to support all kinds of decisions that impact people`s lives, including determining benefits. education; Regulatory compliance and licensing; child protection; immigration; facial recognition and surveillance technology; and police work, bail and sentencing. The problem is not using algorithms and machine learning to control decision-making. It is about telling the public that these machines eliminate all human biases and are 100% objective when it has been proven time and time again that this is not correct. The LCO`s Accountable AI report examines key areas of AI regulation, AI litigation, human rights, administrative law, data protection and civil procedure to determine whether there are gaps or unanswered questions that need to be addressed in order to ensure meaningful legal liability for government AI systems. AI and ADM systems have the potential to transform government decision-making by improving the accuracy and consistency of decision-making and reducing backlogs. Despite this potential, government AI and ADM systems are controversial.
There are many examples of government AI and SMA systems that have been biased, mysterious, inefficient, and have caused significant harm to individuals and communities. “Black boxes” have become a term coined to describe machine learning algorithms because they work in ways that no one can understand. Algorithms repeatedly adapt and weight inputs differently to improve the accuracy of their predictions, and so people struggle to understand how and why algorithms achieve the results they get (Deeks, 2019). This has become a problem in understanding the decisions made by machines, especially in the judicial system. While there are general measures of the performance of AI systems, there is still no established metric to assess the quality of certain AI recommendations or decisions. This poses a serious problem with the emerging use of AI in legal applications, as the legal system strives to achieve good performance not only overall, but also on a case-by-case basis. This article introduces the concept of using the closest neighbors to evaluate the individual performance of AI. This analysis of the nearest neighbor has the advantage of being easy to understand and applies to judges, lawyers and jurors. In addition, it is basically compatible with existing AI methods. This article explains how the concept could be applied to examine AI outcomes in a number of use cases, including civil discoveries, risk prediction, and forensic comparisons, while presenting its limitations. However, given that technical progress has overtaken lawsuits, it`s unclear how the law will treat AI systems. This article briefly examines the legal implications and liability risks associated with reliance on or delegation to AI systems, and outlines a framework that suggests how we can address the question of whether AI deserves a new approach to addressing the liability challenges it raises when humans remain “in” or “on” the loop.

Technological advancements can improve people`s daily lives and achieve amazing results at high speed.
However, AI also has the potential to be biased and harm individuals, depending on the use and design of algorithms.
